Trường hợp nào được giảm trừ gia cảnh

Hàng tháng tôi có gửi tiền nuôi 2 người em đang học đại học. Hỏi tôi có được giảm trừ gia cảnh cho 2 em tôi không?

 

Theo quy định tại tiết 1.2 khoản 1 Điều 2 Thông tư 62/2009/TT-BTC ngày 27 tháng 03 năm 2009 của Bộ Tài chính: “ Người trong độ tuổi lao động được tính là người phụ thuộc phải thoả mãn đồng thời các điều kiện sau:

+ Bị tàn tật không có khả năng lao động;

+ Không có thu nhập hoặc có thu nhập bình quân tháng trong năm từ tất cả các nguồn thu nhập không vượt quá 500.000 đồng”.

Căn cứ vào quy định trên thì 2 người em của ông đang trong độ tuổi lao động nên không đủ điều kiện để kê khai giảm trừ gia cảnh.
